PURCHASE AND SALE RULES
1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the Rules), once approved by the Buyer (after familiarizing themselves with the Rules and checking the box next to the statement "I have familiarized myself with the rules of motin.lt and agree to them"), are a legal document binding on both parties, which defines the rights and obligations of the Buyer and the online store (hereinafter referred to as the Seller), the conditions for purchasing and paying for goods, the parties' responsibilities, the procedure for delivering and returning goods, and other provisions related to the purchase and sale of goods on motin.lt. in the online store .
1.2. The Seller reserves the right to change, amend and supplement these Rules. Changes made by the Seller are related to the requirements of applicable legal acts and do not contradict the principles of common sense.
1.3. By agreeing to the Rules, the Buyer confirms that he is legally competent and has the right to purchase goods in the motin.lt online store.
2. Conclusion of purchase and sale contracts
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart in the online store, clicks the "Order" button.
2.2. Each contract concluded between the Buyer and the Seller is stored in the database of the motin.lt online store.
3. Buyer's rights
3.1. The Buyer has the right to purchase goods in the motin.lt online store in accordance with the procedure established by these Rules and the online store.
3.2. The Buyer has the right to return goods purchased in the motin.lt online store by notifying the Seller in writing (by e-mail: motin@motin.lt , indicating the desired product to be returned and its order number) no later than within 14 (fourteen) calendar days. The return conditions and other information are specified in clause 9 of the Rules "Return and exchange of goods".
4. Buyer's obligations
4.1. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
4.2. The Buyer undertakes not to transfer his login details to third parties. If the Buyer loses his login details, he must immediately inform the Seller about this using the means of communication specified in the "Contacts" section.
4.3. If the data provided in the Buyer's registration form changes, he must immediately update it.
4.4. When using the online store motin.lt , the Buyer undertakes to comply with these Rules, other conditions specified in the online store, and not to violate the legal acts of the Republic of Lithuania.
5. Seller's rights
5.1. If the Buyer attempts to harm the operation or stable operation of the online store, the Seller may, without prior warning, restrict, suspend (terminate) his ability to use the online store.
5.2. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, having chosen to pay in accordance with clause 7.2.2 of the Rules, does not pay for the goods within 3 (three) business days.
5.3. When the Buyer chooses to pay for the goods in accordance with clause 7.2.1 of the Rules, the Seller, in case of any uncertainty regarding the information provided in the order, contacts the Buyer by the phone number specified in the order. In such a case, the delivery period for the goods begins to be calculated from the date of contact with the Buyer. The Seller has the right to cancel the Buyer's order without prior notice if the Seller fails to contact the Buyer within 3 (three) business days.
6. Seller's obligations
6.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store motin.lt under the conditions set out in these Rules and in the online store.
6.2. The Seller undertakes to respect the Buyer's right to privacy regarding personal information belonging to him, specified in the online store registration form, except for cases established by the laws of the Republic of Lithuania and the "Rules on Personal Data Protection".
6.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him under the conditions specified in paragraph 8 of the Rules.
6.4. If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, he undertakes to offer an analogous or as similar product as possible. If the Buyer refuses to accept an analogous or as similar product as possible, the Seller undertakes to refund the money paid to the Buyer within 7 (seven) business days, if an advance payment was made.
7. Prices of goods, payment procedures and terms
7.1. The prices of goods in the online store and in the formed order are indicated in euros.
7.2. Payment for goods can be made in three ways:
7.2.1. Payment by bank transfer is an advance payment when the Buyer transfers money to the motin.lt bank account.
7.2.2. Payment for goods by electronic banking using the Paysera.lt system installed in the motin.lt online store.
7.2.3. Payment via Paypal.
7.3. Upon successful payment for the goods, the order is processed and prepared for shipment within 2 (two) business days.
8. Delivery of goods
8.1. Delivery of goods to the address specified by the buyer:
8.1.1. When ordering goods, the Buyer undertakes to indicate the exact delivery address of the goods.
8.1.2. The Buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims against the Seller regarding the delivery of the goods to an inappropriate entity.
8.1.3. The Goods are delivered by the Seller or its authorized representative.
8.1.4. The Seller delivers the goods within 2-4 days when the goods are in the Seller's warehouse, and up to 14 days when the goods are in production. If the Seller does not have the goods in stock and it is also not possible to produce them, then the Seller returns the money for the unavailable goods to the Buyer.
8.1.5. The terms specified in clause 8.1.4 of the Rules are preliminary and do not apply in cases where the necessary goods are not available in the warehouses of the Seller's suppliers at that time. The Seller is also not responsible for the couriers' obligation to deliver the goods within 2-4 business days.
8.1.6. The Buyer agrees that in exceptional cases, the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of delivery of the goods.
8.1.7. In all cases, after placing an order, the customer is informed of the revised delivery date.
8.1.8. The Seller is exempt from liability for violation of the delivery terms of the goods if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.
8.1.9. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. After the Buyer signs the invoice (waybill) or other document of delivery and acceptance of the shipment, it is considered that the shipment has been transferred in proper condition. Having noticed that the packaging of the delivered shipment is damaged (broken, torn or otherwise externally damaged), the Buyer must note this on the invoice (waybill) or other document of delivery and acceptance of the shipment and, in the presence of the Seller or his representative, draw up a free-form shipment damage report. If the Buyer fails to perform these actions, the Seller is released from liability to the Buyer for damage to the goods, if such damage was caused by damage to the packaging, which the Buyer did not mark in accordance with the procedure established above.
8.1.10. In cases where, upon receipt of the goods, the Buyer notices that the shipment does not contain the correct set of goods or the goods delivered are not of the correct size, color or other dimensions, the Buyer must immediately inform the Seller thereof.
8.1.11. In the case of a non-standard shipment, the Buyer is additionally informed about the exact delivery price.
9. Return and exchange of goods
9.1. Return and exchange of goods is carried out in accordance with the Civil Code of the Republic of Lithuania, Article 6.362 Exchange and return of items.
9.2. Conditions for returning goods of suitable quality:
9.2.1. Purchased goods of suitable quality can be returned within 14 (fourteen) calendar days from the date of their delivery.
9.2.2. The returned item must be in its original, neat packaging.
9.2.3. The product must be undamaged.
9.2.4. The product must be unused and in good condition (changes to the appearance of the packaging that were necessary to inspect the received product are not considered to be substantial changes to the appearance of the product).
9.2.5. The product must be complete.
9.2.6. Courier services are paid for by the Buyer.
9.3. Conditions for returning defective goods:
9.3.1. Goods of inadequate quality can be returned within 14 (fourteen) calendar days from the date of their delivery.
9.3.2. The defects in the returned goods were not due to the fault of the Buyer.
9.3.3. The returned item is not complete.
9.5. In all cases, when returning a product, it is necessary to provide a document confirming the purchase of the product.
9.6. Money for returned goods is transferred to the Buyer's bank account.
10. Responsibility
10.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller is not responsible for the consequences arising therefrom.
10.2. The buyer is responsible for actions taken while using the motin.lt online store.
10.3. The Buyer is responsible for the transfer of his/her login data to third parties. If the services provided by motin.lt are used by a third party who has logged into the online store using the Buyer's login data, the Seller considers this person to be the Buyer.
10.4. The Seller is exempted from any liability in cases where losses arise due to the Buyer not having taken into account the Seller's recommendations and his obligations and not having familiarized himself with these Rules, although he was given such an opportunity.
10.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained there or the activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
10.6. In the event of damage, the party found at fault shall compensate the injured party for direct losses.
11. Final provisions
11.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
11.2. The law of the Republic of Lithuania shall apply to relations arising under these Rules.
11.3. All disagreements arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
